WARRANTY:

The duration of the warranty for each of these motor vehicles varies by manufacturer and/or model. The duration of the manufacturer’s warranty is clearly indicated in each vehicle listing and is subject to the policy and procedures of that manufacturer.
  
Family Motorsports (FMS) Manufacturer Limited Warranty Details:
 
The warranty is divided into two categories (parts and motor) and the duration of each category may vary by model. Duration of the warranty is stated in a length of months and/or years. Duration of the warranty is limited to a distance of ten thousand miles per year. The warranty expires upon reaching the stated duration or driving the total number of miles calculated for the warranty length. The warranty, in part or as a whole, may be rendered null and void under certain conditions as described in this warranty.
 
Family Motorsports Responsibilities:
  • FMS shall have sole discretion in determining if a malfunctions or damage is due to a defect in materials, workmanship, or manufacturing process or is a result of vehicle abuse, misuse, accident, negligence, etc.
  • The warranty specifically covers the part(s) and shipping to the customer. Any part(s) covered under this warranty will be repaired or replaced at the sole discretion of FMS. Repairs will be performed in a manner consistent with generally accepted practices of the automotive industry to return a repairable item to “as close to factory specification as mechanically possible”. Any component(s) that are replaced under this warranty will be replaced with a component(s) of like kind and quality. Replacement parts provided by this warranty are understood to be provided on a "one for one exchange". FMS will not pay for or reimburse the cost of part(s) obtained or purchased by the customer from a third party vendor.

  • Family Motorsports will only be responsible for basic ground shipping charges. Family Motorsports is not be responsible for the cost incurred for expatiated shipping. Family Motorsports will process orders in the order in which they received and shall make every reasonable effort to process every order with in 3-5 business days.

  • Family Motorsports does not pay for labor for the diagnosis of any system(s) of the vehicle, removal, installation and/or replacement of part(s) except as indicated under the conditions of the FMS Limited In-House Labor Policy.
FMS Limited Parts Warranty:
 
The term parts is understood to be synonymous with component, item, piece and/or any other term that, in general, describes any manufactured metal, or electrical component contained on and/or within the vehicle as it was produced by the manufacturer.
 
This warranty covers the following parts for the duration of the warranty except when excluded by specific conditions identified in the "FMS Manufacturer Limited Warranty Details".
 
Parts: Any manufactured metal, or electrical component contained on and/or within the vehicle as it was produced by the manufacturer, excluding any part covered under the FMS Limited Engine Warranty, is warranted against failure due to defect in materials, workmanship, or manufacturing process.
 
Any body plastic panel and accessories such as rear trunk, luggage rack, mirrors will be replaced only if a "shipping damage claim" is successfully filed (see "Shipping Information" for detail). Body panels and accessories are NOT covered by FMS Manufacturer Limited Warranty for any reason.

All defective parts must be returned to Family Motorsports or to its wholesale division in CA or TX at your expense for inspection and verification of defect before the replacement parts can be shipped to you. COD or badly damaged package due to poor packaging will be refused and returned to you. FMS and its wholesale divisions reserve the right to decline any warranty claim based on the criteria listed in the CONDITIONS portion of this warranty.

WHY DO YOU WANT MY PART BACK?
We may need your part for several reasons:
  • We carry variety models from different manufacturers, and changes/upgrades on each model are often made by the manufacturer, therefore we need to match up and make sure your replacement part is the correct one before sending it to you.
  • We require the part back so we may monitor defective parts and notify the manufacturer about potential future problems or recalls.
  • We need to verify that your part is in fact defective. Many times we received parts back that were not defective at all. Our Parts Dept. does no longer send out parts base on pictures or verbal/written notice from customer or repair shops.
  • Part(s) under warranty must be sent back at your expense in order to receive free exchanges.
Conditions:
 
The FMS Limited Parts Warranty is effective only under the following conditions:
  1. All scheduled maintenance was performed, including but not limited to engine oil changes, transmission fluid changes, and valve lash adjustments, at the appropriate interval in a manner consistent with the owner’s manual, the GY6 repair manual, procedures described by FMS Technical Support, or other methods generally accepted as proper by the automotive industry.
  2. The cooling system must have remained in good working condition at all times, the cooling system and the reservoir must have remained filled with to the correct levels with a 50 percent mix of ethylene glycol or propylene glycol and distilled water coolant, and all auxiliary systems of the cooling system, including but no limited to cooling fan(s), gauge(s), relief valve(s), external pump(s), and hose(s), must have remained in good working condition at all times, except in the event of a warranted failure in the cooling system, in which case the engine must have be stopped immediately and repaired prior to resuming use.
  3. The vehicle has not been loaded beyond the maximum vehicle load capacity listed in the owner’s manual.
  4. The vehicle is used under normal conditions for its intended purpose.
 FMS Limited Parts Warranty exclusions include but are not limited to the following:
  1. Maintenance and standard wear items such as but not limited to seat(s), handgrip(s), filter(s), tire(s), brake pad(s) or shoe(s) and drive belt(s).
  2. Maintenance and standard wear items such as battery(s), light bulb(s), engine mount(s), rubber bushing(s) and hose(s), which are warranted for 7 days against manufacturer defect only.
  3. Decorative or convenience items that are not critical to vehicle function such as cup holders, clocks, mud flaps, curb feelers.
  4. Factory installed optional electronics such as accent lights, alarm systems, remote starters and audio equipment.
  5. Malfunctions caused by factory or customer installed 3rd party electronics.
  6. Damage to a covered component is solely the result of and/or caused by a failure in any non-covered component.
  7. Any item specifically covered by the FMS Limited Engine Warranty.
The FMS Limited Parts Warranty is rendered null and void under the following conditions:
  1. FMS is not provided a reasonable opportunity to inspect a covered component prior to repair or replacement of that component.
  2. Vehicles used for extreme or abusive riding, and racing or competition.
  3. Any system has been modified to other than factory specifications.
  4. Damages due to natural phenomenon, including hail, flood or fire.
  5. Damages due to collision, accident, abuse, or negligence.
  6. Damages due to sabotage, espionage, or subversion.
  7. Vehicle is used in the commission of a crime.
  8. Vehicles used by unqualified operators.
  9. Unauthorized third party repair.

FMS Limited Engine Warranty:

 
The term engine is understood to be synonymous with motor, power train, and/or other term that describes, in general, the internal combustion engine and integrated continuously variable transmission. Reference to any such term is implied to refer to the engine and the coverage of the FMS Limited Engine Warranty. The term transmission is understood to be synonymous with gear box, final drive, drive train and/or any other term that describes, in general, the internally encased and lubricated system of driven gears and connected input and output shafts. Reference to any such term is implied to refer to the transmission and the coverage of the FMS Limited Engine Warranty. The term differential is understood to describe, in general, the internally encased and lubricated system of driven gears and connected input and output shafts of a differential gear box, if the vehicle is equipped with one. The term transfer is understood to describe, in general, the internally encased and lubricated system of driven gears and connected input and output shafts of a transfer gear box, if the vehicle is equipped with one.

This warranty covers the following parts for the duration of the warranty except when excluded by specific conditions identified in the FMS Manufacturer Limited Warranty.

 
Engine: The engine assembly, limited to internally lubricated parts, such as but not limited to: piston(s), wrist pin(s), wrist pin clip(s), connecting rod(s), crankshaft(s), camshaft(s), main bearing(s), camshaft bearing(s), timing chain gear(s), rocker arm(s), rocker arm shaft(s), valve spring retainer(s), valve guide(s), valve push rod(s), valve lifter(s), internal oil pump(s), internal water pump(s), water pump bearing(s), accessory chain gear(s), starter clutch(s), starter reduction gear(s), stator(s), flywheel(s), magneto rotor(s) and any associated shaft(s), is warranted against failure due to defect in materials, workmanship, or manufacturing process except when failure is associated with a failure resulting from improper valve lash and/or timing chain tension.
 
Additionally, the crankcase(s), engine head(s), cylinder(s), camshaft cover(s) and internal engine casting(s) are warranted against failure due to defect in materials, workmanship, or manufacturing process and/or damage caused solely as a result of the mechanical failure of one or more of the internally lubricated components specified above except when associated with a failure resulting from improper valve lash and/or timing chain tension.
 
Parts that are expected to wear with use, including but not limited to ring(s), timing chain(s), timing chain guide(s), timing chain tensioner(s), accessory chain(s), valve spring(s), valve(s), valve seat(s) and valve lash adjustment screw(s) are warranted against failure due to defect in materials, workmanship, or manufacturing process except when failure is a result caused by wear.
 
Transmission: The transmission, limited to the input shaft(s), internally lubricated part(s) contained within the transmission case, and the output shaft(s), is warranted against failure due to defect in materials, workmanship, or manufacturing process.

The transmission case(s), including the transmission integrated left engine crankcase(s), are warranted against failure due to defect in materials, workmanship, or manufacturing process and/or damage caused solely as a result of the mechanical failure of one or more of the internally lubricated components contained within the transmission case, the variator assembly, or the clutch assembly.

 
Parts that are expected to wear with use, including but not limited to the variator assembly, consisting of the inner cone half, outer cone half, center sleeve, retainer, ramp plate, restrictor plate, ramp guides, and roller weights, and clutch assembly, consisting of the clutch drum, clutch shoes, clutch springs, clutch shoe retainer, center spring, back plate, center sleeve, inner pulley half, and outer pulley half, are warranted against failure due to defect in materials, workmanship, or manufacturing process except when failure is a result caused by wear.
 
Transfer: The transfer, limited to the input shaft(s), internally lubricated part(s) contained within the transfer case, and the output shaft(s), is warranted against failure due to defect in materials, workmanship, or manufacturing process.

The transfer case(s), are warranted against failure due to defect in materials, workmanship, or manufacturing process and/or damage caused solely as a result of the mechanical failure of one or more of the internally lubricated components contained within the transfer case.

 
Differential: The differential, limited to the input shaft(s), internally lubricated part(s) contained within the differential case, and the output shaft(s), is warranted against failure due to defect in materials, workmanship, or manufacturing process.

The differential case(s), are warranted against failure due to defect in materials, workmanship, or manufacturing process and/or damage caused solely as a result of the mechanical failure of one or more of the internally lubricated components contained within the differential case.

 
Conditions:
 
The FMS Limited Engine Warranty is effective only under the following conditions:
  1. All scheduled maintenance was performed, including but not limited to engine oil changes, transmission fluid changes, and valve lash adjustments, at the appropriate interval in a manner consistent with the owner’s manual, the GY6 repair manual, procedures described by FMS Technical Support, or other methods generally accepted as proper by the automotive industry.
  2. The cooling system must have remained in good working condition at all times, the cooling system and the reservoir must have remained filled with to the correct levels with a 50 percent mix of ethylene glycol or propylene glycol and distilled water coolant, and all auxiliary systems of the cooling system, including but no limited to cooling fan(s), gauge(s), relief valve(s), external pump(s), and hose(s), must have remained in good working condition at all times, except in the event of a warranted failure in the cooling system, in which case the engine must have be stopped immediately and repaired prior to resuming use.
  3. The vehicle has not been loaded beyond the maximum vehicle load capacity listed in the owner’s manual.
  4. The vehicle is used under normal conditions for its intended purpose.

FMS Limited Engine Warranty exclusions include but are not limited to the following:

  1. Rubber or fiber items such as but not limited to gasket(s), seal(s) and hose(s), which are warranted for 7 days against manufacturer defect only.
  2. Maintenance and standard wear items such as but not limited to spark plug(s), spark plug wire(s), drive belt(s), fluid(s) and non-permanent filter(s).
  3. Accessory items, including but not limited to electrical components of all types such as distributor(s), external alternator(s), voltage regulator(s), charging system diode(s), captive discharge ignition module(s), magnetic pickup(s), ignition coil(s), solenoid(s), spark plug wire(s), sensor(s), automatic electrical switch(s) and other electrical control device(s) (except item stators), fuel system components, cooling systems components (except internal water pumps), engine mount(s), rubber bushing(s) and linkage(s).
  4. Damage to a covered component is solely the result of and/or caused by a failure in any non-covered component.
  5. Any item specifically covered by the FMS Limited Parts Warranty.

 The FMS Limited Engine Warranty is rendered null and void under the following conditions:

  1. FMS is not provided a reasonable opportunity to review vendors ASE, other factory qualification, and/or itemized labor estimate prior to work being performed.
  2. Vehicles used for extreme or abusive riding, and racing or competition.
  3.  Any system has been modified to other than factory specifications.
  4. Damages due to natural phenomenon, including hail, flood or fire.
  5. Damages due to collision, accident, abuse, or negligence.
  6. Damages due to sabotage, espionage, or subversion.

FMS Optional Extended Warranty:
 
Optional extended warranty maybe offered and must be purchased concurrently with the purchase of the vehicle at the pricing posted in that vehicle's listing. The pricing will be 2 times more if customer decides to purchase the extended warranty after the vehicle is delivered. Extended warranties are non-refundable for any reason. Extended warranty coverage extends only the time duration and distance limitations of the Family Motorsports Manufacturer Limited Part Warranty and Family Motorsports Manufacturer Limited Engine Warranty for the additional duration and calculated distance of the extension which is purchased. The extension is cumulative and begins at the expiration of the manufacturer’s factory warranty. Vehicles not originally covered by the FMS Manufacturer Limited Warranty will be transferred to the Family Motorsports Optional Extended Warranty Coverage at the expiration of the original manufacturer warranty.
 
All coverage under the Family Motorsports Optional Extended Warranty is provided under the same limitation, exclusions, and conditions as the FMS Manufacturer Limited Warranty. Specific overages are subject to the terms of this agreement regardless of the vehicles original manufacturer.
 

Family Motorsports Limited In-House Labor Policy (does NOT apply to any off-road vehicles):
 
This policy is not a warranty; the consumer is expected to perform functions beyond notification in order to receive benefits under this policy. The term labor is understood to describe, in general, the manual work required to diagnosis, troubleshoot, test and/or perform a repair on an on-road vehicle.
 
This policy only covers the cost labor, at a labor rate up to $40/hr and for at an hour unit value consistent with the Mitchell Labor Guide for Motorcycles or other similar publication, limited to the actual cost of work performed by FMS or the amount of labor pre-authorized by FMS and performed by a third party vendor for a period of 12 months from the date of delivery. Additionally, this policy is excluded from the extension under the Family Motorsports Optional Extended Warranty Coverage, and applies to on-road vehicles only.
 
Conditions:
 
The FMS Limited In-House Labor Policy is effective only under the following conditions:
  1. All scheduled maintenance was performed, including but not limited to engine oil changes, transmission fluid changes, and valve lash adjustments, at the appropriate interval in a manner consistent with the owner’s manual, the GY6 repair manual, procedures described by FMS Technical Support, or other methods generally accepted as proper by the automotive industry.
  2. The cooling system must have remained in good working condition at all times, the cooling system and the reservoir must have remained filled with to the correct levels with a 50 percent mix of ethylene glycol or propylene glycol and distilled water coolant, and all auxiliary systems of the cooling system, including but no limited to cooling fan(s), gauge(s), relief valve(s), external pump(s), and hose(s), must have remained in good working condition at all times, except in the event of a warranted failure in the cooling system, in which case the engine must have be stopped immediately and repaired prior to resuming use.
  3. The scooter has not been loaded beyond the maximum vehicle load capacity listed in the owner’s manual.
  4. The vehicle is used under normal conditions for its intended purpose.
  5. You have contacted FMS and attempted the repair yourself and/or the repair is determined by FMS to be beyond the capability of the average consumer.
  6. You are not geographically located within a reasonable driving distance of FMS.
  7. FMS has received a request for warranty coverage, a copy of the ASE certification or other factory certification of your selected repair shop and an itemized labor estimate, prior to any work being performed.
  8. FMS has approved the request for warranty coverage prior to work being performed.

FMS Limited In-House Labor Policy exclusions include but are not limited to the following:

  1. Labor to perform scheduled maintenance and/or general maintenance.
  2. Any labor that was not pre-approved by FMS.
  3. Off-road vehicles (ATV's, Go-karts, Dirt bikes and Utility vehicles).

 
Purchaser’s Responsibilities:
 
Purchaser acknowledges acceptance of the risks of riding a motor vehicle and acknowledges that he or she is qualified to operate a scooter as purchased from Family Motorsports. Purchaser understands that they must abide by the motor vehicle laws of their state. Purchaser is responsible for any required titling, registration, inspections, and insurance that may be required by their state for this motor vehicle before use. Purchaser must be in good physical and mental condition to ride a scooter. If purchaser is not familiar with operating a scooter, purchaser should seek professional training and be fully competent before riding their scooter.
 
Scooters are inspected and tested prior to shipping and shipped in working condition. Scooter should be assembled by a licensed mechanic. Purchaser/mechanic is responsible for reconnecting any loose wires, nuts, bolts and/or screw that have may have developed during shipping. In the event a wire, screw, nut or bolt has become loose, attempts to assist the customer in reconnecting the loose part will be made. Because the dealer cannot be present at the scooter, no guarantee is made of successful reconnection. Mechanic prepping scooter must check all systems to determine functionality.
 
If any part is found to be defective, the customer will send part back to dealer and it will be repaired or replaced free of charge. The customer must ship the requested part to Family Motorsports for repair or replacement. The customer is responsible for shipping charges from their location to Family Motorsports. Customers will not be reimbursed for parts purchased from third party vendors; warranty covers only parts provided by dealer or manufacturer.
 
Customers are expected to perform the labor or hire a mechanic at customer’s expense to remove, install and/or replace, the part(s) provided under this warranty. Customer is liable for labor charge to replace any part covered by warranty except as indicated under the conditions of the FMS Limited Labor Warranty.

 

Any towing charges incurred are the responsibility of the customer.

 
The presence of a defective part on a scooter will not be considered a reason to return scooter. In no circumstance shall a loose wire, screw, nut or bolt be considered a reason for return of scooter. Scooters may only be returned by following the FMS return policy.
 
Risks Inherent to Operation:
 
Operating a scooter involves risks and dangers involving serious bodily injury. These risks and dangers also include but are not limited to paralysis, disability, dismemberment, and death. These inherent risks may be the result of purchaser's own actions or non-actions involving: themselves, others, or specific circumstances of the activity occurring, or the neglect or negligence of themselves and or others. There may be other risks known or unknown to
Purchaser. Purchaser assumes all risks and fully assumes and accepts responsibility for events that may not be foreseeable including economic loss, social distress, losses, costs, and damages caused as a result of person's vehicle riding activities.
 
No implied warranties or agreements:
 
There are no agreements or warranties, expressed or implied, including warranties of fitness for a particular purpose, other than those stated in this agreement. Family Motorsports shall not be responsible for payment of damages, other than the sums specified in this agreement, including incidental and/or consequential loss or damages arising from injury, loss of use, loss of time, rental vehicles, profits, or income to the customer as a result of a failure of any component or part.
 
Non-Transferability:
 
This agreement is provided to the original purchaser and is non transferable.
